Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to SongBouquet.com and your purchase or use of services offered by SongBouquet (“SongBouquet,” “we,” “us,” or “our”), operated by [LEGAL BUSINESS NAME].

By using our website, submitting an order, or selecting a checkbox indicating your agreement, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our website or purchase our services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order. If you purchase a song on behalf of another person or organization, you represent that you have authority to do so.

2. SongBouquet’s Services

SongBouquet connects customers with independent singers, songwriters, musicians, and producers who create personalized songs using information supplied by the customer.

Each song is a custom creative work. Musical style, melody, instrumentation, vocal performance, production, and the way submitted details are incorporated involve the artist’s creative judgment. Examples and previous songs illustrate general quality and style but do not guarantee that a new song will sound exactly the same.

3. Placing an Order

You agree to provide complete, accurate, and timely information, including:

  • A working email address

  • The requested delivery date

  • Musical and artist preferences

  • Names and pronunciation guidance

  • Stories and details to be considered for the song

  • Any information identified as especially important or “must-have”

The artist may not be able to include every submitted detail. You are responsible for reviewing your submission before sending it.

If clarification is required, delivery may be delayed until you respond. SongBouquet is not responsible for delays caused by incomplete information, incorrect contact information, late responses, or requested changes after production begins.

4. Information About Other People

You may submit information about another person only when you have the right or appropriate permission to share it.

You agree not to submit content that:

  • Is false, defamatory, threatening, harassing, hateful, or unlawful

  • Violates another person’s privacy, publicity, copyright, trademark, or other rights

  • Includes confidential information you are not authorized to disclose

  • Encourages violence or illegal activity

  • Contains sexually explicit content involving a minor

  • Is intended to impersonate, defraud, or materially mislead someone

We may refuse, cancel, or request changes to an order that violates these Terms or could reasonably harm an artist, SongBouquet, or another person.

If we cancel an order solely because we cannot fulfill it, we will refund the amount paid for the unfulfilled service.

5. Artist Selection and Substitution

We will make reasonable efforts to assign the artist selected during checkout. However, availability can change because of illness, scheduling conflicts, technical problems, or other circumstances.

If the selected artist becomes unavailable, we may offer:

  • A substitute artist with reasonably similar capabilities

  • A revised delivery date

  • Store credit

  • A refund for the affected order

We will not substitute the selected artist without notifying you when reasonably possible.

6. Prices and Payment

Prices are displayed at checkout and may change at any time before an order is submitted. You agree to pay the displayed price, applicable taxes, and any selected add-on or rush-delivery fees.

Payments may be processed by a third-party provider. You authorize us and the payment provider to charge the payment method submitted at checkout.

Discounts and promotional codes:

  • Must be used before their expiration date

  • Have no cash value

  • May be limited to one per order

  • May not be combined unless expressly allowed

  • May be withdrawn or modified before an order is placed

7. Cancellations and Refunds

Because each song is custom-created, cancellation and refund rights are limited once work begins.

Standard-Delivery Orders

A standard-delivery order may be canceled within 24 hours after purchase for a refund. After that 24-hour period, the order generally cannot be canceled or refunded because an artist may have begun working on it.

Rush or Expedited Orders

Rush and expedited orders cannot ordinarily be canceled after purchase because production may begin immediately.

Exceptions

Nothing in these Terms limits any refund, cancellation, or other consumer right that cannot legally be waived.

If SongBouquet cannot fulfill an order, we may offer a replacement artist, revised delivery date, store credit, or refund, depending on the circumstances.

Dissatisfaction based solely on creative preference does not automatically qualify an order for a refund when the delivered song materially follows the submitted instructions.

8. Delivery

Completed songs are generally delivered by email through a link to a personal song page. You are responsible for:

  • Providing the correct email address

  • Checking spam, junk, and promotional folders

  • Ensuring that your inbox can receive our messages

  • Downloading and safely storing the completed files

Delivery times shown on the website are estimates unless checkout expressly identifies a guaranteed delivery date.

We are not responsible for delays caused by inaccurate submissions, delayed customer responses, requested changes, payment problems, platform outages, emergencies, or circumstances outside our reasonable control.

If a paid rush deadline is missed solely because of SongBouquet or the assigned artist, contact us. Depending on the circumstances, we may refund the rush-delivery surcharge. This does not apply when the delay was caused by the customer or circumstances outside our reasonable control.

9. Personal Song Pages

Your song may be delivered through a page accessible using a unique link. The page is not necessarily password-protected.

Anyone who receives the link may be able to listen to, download, or share the song. You are responsible for deciding who receives the link and for notifying us promptly if you believe it has been accessed improperly.

We may modify the design or technical features of song pages. You should download and preserve your completed song rather than relying on permanent website hosting.

10. Revisions and Corrections

Each order includes one complimentary revision covering minor matters such as:

  • A factual lyrical correction

  • A reasonable pronunciation adjustment

  • A small wording change

  • Correction of a clear artist error

Revision requests must be submitted within seven days after delivery. If you believe the artist made a significant mistake, please notify us as soon as possible, preferably within 72 hours.

The complimentary revision does not ordinarily include:

  • Rewriting substantial portions of the song

  • Changing the genre or overall creative direction

  • Replacing details that were correctly based on the original submission

  • Adding material not provided with the original order

  • Re-recording the entire song because of a change in personal preference

  • Changing the selected artist or vocalist

Major changes, additional revisions, extra verses, or new instructions may require an additional fee. We will disclose the additional price before beginning paid revision work.

Revision processing may take up to an additional 72 hours or longer depending on the request and artist availability. The original delivery estimate does not include revision time.

11. Creative Satisfaction

Music is subjective. We do not guarantee that every customer or recipient will have a particular emotional reaction or personally prefer every creative decision.

If you are dissatisfied, contact us promptly and explain the specific issue. We will review whether the song materially followed the order instructions and whether a correction, paid rewrite, replacement, credit, or other resolution is appropriate.

12. Ownership of Completed Songs

Unless a separate written agreement expressly states otherwise, the artist or applicable rights holder retains ownership of the song, lyrics, composition, performance, production, master recording, and associated intellectual-property rights.

Purchasing a custom song does not automatically transfer copyright or master ownership to the customer.

After full payment, the customer receives a perpetual, nonexclusive, nontransferable license to use the delivered song for personal, noncommercial purposes, including:

  • Listening to and downloading the song

  • Giving it to the intended recipient

  • Sharing it privately with friends and family

  • Playing it at personal celebrations or events

  • Posting it to a personal, noncommercial social-media account, subject to the platform’s rules and third-party rights

Unless separately authorized in writing, you may not:

  • Sell, sublicense, or commercially distribute the song

  • Register the song or recording as your own copyrighted work

  • Claim authorship or exclusive ownership

  • Release it commercially through Spotify, Apple Music, YouTube Content ID, or another monetized distribution service

  • Use it in paid advertising, commercial productions, merchandise, political campaigns, or business promotions

  • Create or authorize derivative commercial works

  • Remove or falsify available authorship or ownership information

Contact SongBouquet if you want commercial usage, distribution, copyright ownership, master ownership, or another expanded license. Additional permissions and fees may apply.

13. Customer-Submitted Content

You retain any rights you already hold in the stories, photographs, recordings, text, or other materials you submit.

You grant SongBouquet, the assigned artist, and necessary service providers a limited license to access, reproduce, adapt, record, transmit, and otherwise use submitted materials as reasonably necessary to:

  • Create and revise your song

  • Communicate about the order

  • Deliver and host the completed song

  • Provide customer support

  • Maintain legally required business records

You represent that you have the necessary rights and permissions to provide these materials and authorize these uses.

14. Promotional Use and Testimonials

SongBouquet will not use your private story, completed song, photograph, reaction video, or testimonial in public advertising solely because you placed an order.

We may request separate permission to feature customer content. If you grant permission, the agreed use will be governed by the applicable consent or release.

You remain free to provide an honest review. Nothing in these Terms prohibits or penalizes honest statements about your experience.

15. Website Content

The SongBouquet name, website design, graphics, logos, text, videos, artist profiles, and other website materials are owned by SongBouquet or used with permission.

You may not copy, scrape, reproduce, modify, distribute, sell, or commercially exploit website content without prior written permission, except as allowed by law.

16. Third-Party Services

Our website may link to or rely upon Wix, payment processors, social networks, streaming platforms, artists’ websites, and other third-party services. Those services operate under their own terms and policies.

We are not responsible for third-party websites, outages, policies, security practices, or content.

17. Prohibited Conduct

You may not:

  • Use the website for fraud or unlawful activity

  • Interfere with website security or operation

  • Upload malicious code

  • Attempt unauthorized access to accounts, files, or song pages

  • Scrape or harvest information from the website

  • Misrepresent your identity or authority

  • Abuse, threaten, or harass artists, customers, or staff

  • Use a delivered song outside the granted license

  • Submit a knowingly false payment dispute or chargeback

18. Payment Disputes

If you believe a charge is incorrect or an order was not properly fulfilled, please contact us first so we can investigate.

Nothing in these Terms prevents you from exercising legitimate rights through your payment provider or applicable law. Knowingly submitting false information in connection with a chargeback or payment dispute may violate these Terms and applicable law.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided “as is” and “as available.” SongBouquet disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant that the website will always be uninterrupted, error-free, or completely secure, or that a song will produce a particular personal or emotional response.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

20. Limitation of Liability

To the fullest extent permitted by law, SongBouquet and its owners, employees, contractors, artists, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website, an order, or a completed song.

To the fullest extent permitted by law, SongBouquet’s total liability relating to a particular order will not exceed the amount you paid to SongBouquet for that order.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless SongBouquet and its owners, employees, contractors, artists, and service providers from third-party claims arising from:

  • Materials or information you submitted

  • Your violation of another person’s rights

  • Your unlawful or unauthorized use of a completed song

  • Your material violation of these Terms

This section does not require you to indemnify any party for that party’s own fraud, willful misconduct, or other liability that cannot legally be shifted to you.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Before filing a legal claim, you and SongBouquet agree to make a reasonable good-faith effort to resolve the dispute informally by written communication.

Unless applicable law gives you the right to bring a claim elsewhere, legal proceedings arising from these Terms will be brought in the appropriate state or federal court located in Los Angeles County, California.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court.

23. Changes to These Terms

We may update these Terms periodically. Updated Terms apply prospectively beginning on the posted effective date. The terms in effect when you placed an order will generally govern that order unless a change is legally required or you agree otherwise.

24. Severability and Waiver

If any provision is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Our failure to enforce a provision does not waive our right to enforce it later.

25. Entire Agreement

These Terms, the Privacy Policy, the checkout information, and any written order-specific agreement constitute the agreement between you and SongBouquet concerning your purchase and use of the services.

If an order-specific written agreement expressly conflicts with these Terms, the order-specific agreement controls for that order.
